1. Acceptance of Terms

Welcome to +EV Bets. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and +EV Bets LLC, a Michigan limited liability company ("Company," "we," "us," or "our"). By accessing or using our website at plusevbets.com and any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Service Description and Limitations

+EV Bets provides sports betting analytics, statistical models, odds comparison tools, and informational content (collectively, "Analytics"). Our Service includes proprietary analytical tools such as the +EVBets FairLine™ that compare market odds against statistical projections to identify potential betting value.

IMPORTANT: +EV Bets is NOT a sportsbook, gambling operator, or betting platform. We do not accept wagers, process bets, or handle any gambling transactions. We provide informational and analytical tools only.

Our Analytics are provided for informational and entertainment purposes only. They do not constitute gambling advice, investment advice, financial advice, or any other form of professional advice. You acknowledge that:

• Past performance of any analytical model does not guarantee future results

• Sports betting involves substantial risk of financial loss

• You are solely responsible for your betting decisions and any resulting gains or losses

• Our Analytics may contain errors, inaccuracies, or outdated information

• Odds and lines change rapidly and may differ from what is displayed

3. User Eligibility

To use the Service, you must:

• Be at least 21 years of age (or the legal gambling age in your jurisdiction, whichever is higher)

• Be located in a jurisdiction where accessing sports betting information is legal

• Have the legal capacity to enter into a binding agreement

• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and to refuse service to anyone at our sole discretion.

4. Account Registration and Security

Certain features of the Service require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information

• Maintain and promptly update your account information

• Maintain the security and confidentiality of your login credentials

• Accept responsibility for all activities that occur under your account

• Notify us immediately of any unauthorized use of your account

We use Auth0 for authentication services. By creating an account, you also agree to Auth0's terms of service and privacy policy. We are not responsible for any security breaches or unauthorized access resulting from your failure to maintain the confidentiality of your credentials.

5. Subscription Terms and Billing

+EV Bets offers both free and paid subscription tiers. Our paid subscription ("Premium") provides access to additional features and Analytics.

Pricing: Current subscription pricing is displayed on our pricing page. Prices are in U.S. dollars and are subject to change. We will provide notice of any price changes before they take effect for existing subscribers.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.

Automatic Renewal: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate upon renewal. You may cancel your subscription at any time through your account settings or by contacting us.

6. Free Trial Terms

We may offer a free trial period for new subscribers. During the free trial, you will have access to Premium features at no charge.

Trial Conversion: At the end of your free trial, your subscription will automatically convert to a paid subscription, and your payment method will be charged the applicable subscription fee unless you cancel before the trial ends.

Eligibility: Free trials are limited to one per person and one per household. We reserve the right to determine trial eligibility and to revoke trial access if we believe terms are being abused.

7. Cancellation and Refund Policy

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to Premium features until the end of your current billing period. No partial refunds will be provided for unused portions of a billing period.

Refunds: Due to the nature of our digital service and the availability of a free trial period, we generally do not offer refunds for subscription payments. However, we may consider refund requests on a case-by-case basis at our sole discretion. To request a refund, please contact us at [email protected] within 7 days of your charge.

Account Termination: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. If we terminate your account without cause, we will provide a pro-rata refund of any prepaid subscription fees.

8. Intellectual Property Rights

The Service and its entire contents, features, and functionality—including but not limited to the +EVBets FairLine™, all text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof—are owned by +EV Bets LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

"+EV Bets," "+EVBets FairLine," and our logos are trademarks of +EV Bets LLC. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. You may not:

• Copy, modify, or distribute any content from the Service

• Use any data mining, robots, or similar data gathering methods

• Reverse engineer or attempt to extract source code from the Service

• Resell, sublicense, or commercially exploit the Service or its content

• Remove any copyright or proprietary notices

9. User Conduct

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights

• Engage in any fraudulent, deceptive, or harmful conduct

• Interfere with or disrupt the Service or servers

• Attempt to gain unauthorized access to any part of the Service

• Use the Service for any commercial purpose without authorization

• Share your account credentials with others

• Circumvent any access controls or usage limits

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free

• The Analytics will be accurate, reliable, or complete

• Any errors will be corrected

• The Service will meet your requirements or expectations

• Use of the Service will result in any particular outcome, including financial gain

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL +EV BETS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You specifically acknowledge that we are not liable for any losses you may incur from sports betting or any other gambling activity, regardless of whether such activity was informed by our Analytics.

12. Indemnification

You agree to indemnify, defend, and hold harmless +EV Bets LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service

• Your violation of these Terms

• Your violation of any applicable law or third-party rights

• Any betting or gambling activity you engage in

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you and +EV Bets LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Michigan, unless you and we agree otherwise.

Class Action Waiver: YOU AND +EV BETS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Governing Law

These Terms and any dispute arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. To the extent that arbitration is not applicable, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Michigan.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last modified" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

For material changes that adversely affect your rights, we will provide at least 30 days' notice before the changes take effect. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and +EV Bets LLC regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
